About Application for Travel Document

The travel document allows anyone living in the United States to travel abroad and reenter after a short trip while waiting for their green card. The USCIS denies any green card application as soon as the applicant leaves the United States while that application is pending unless he/she has a valid travel document. So, this is mandatory to travel internationally until one becomes a lawful permanent resident of the U.S.

USCIS dedicated the Form-131 to three different types of travel documents:

  1. Permit: Lawful or conditional permanent residents who plan to travel abroad for more than one year may apply for admission to the United States upon returning from outside the U.S.
  2. Refugee Travel Document: Individuals with granted refugee or asylum status can apply for this type of travel document to travel abroad and return to the United States.
  3. Advance Parole Document: It is a temporary travel authorization that gives nonimmigrants permission to reenter the United States after traveling abroad.

Eligibility to Apply for Travel Document

Eligibility requirements for the Application for Travel Document are listed below.

  1. Reentry Permit
    1. The applicant must be either a lawful permanent resident or a conditional permanent resident
    2. The applicant must be physically present in the United States at the time of filing the Reentry Permit
    3. The applicant must not have already been issued such a document or must prove that the previously issued document was lost
  2. Refugee Travel Document
    1. The applicant must have a granted refugee or asylee status
    2. The refugee or asylee must apply for a travel document before leaving the United States
    3. The applicant must appear to have the biometrics collected (if required)
  3. Advance Parole Document
    1. The applicant has a pending adjustment of status application (Form I-485) or Temporary Protected status Application (Form I-821)
    2. The applicant has been granted parole pursuant/temporary resident pursuant/V nonimmigrant status and seeking temporary travel abroad for urgent humanitarian reasons
    3. The applicant must not hold a nonimmigrant status, such as J-1, B-2, H-3 etc.
    4. The applicant must not depart from the United States before the Advance Parole Document is issued.
